1. General
This site compares prices and timetables for ferry journeys and allows you to book journeys. The website is owned and operated by Simple Ferry, a public company with limited liability, registered at the Commercial Court in Pazin, Croatia, under subject ID 130130157, referred to in these Terms and Conditions as 'We', 'Us' or the 'Company'. Your use of this website is expressly conditioned upon your acceptance of the following Terms and Conditions. By using this website, you signify your agreement to these Terms and Conditions. If you do not agree to any part of the following Terms and Conditions, do not use this website. We may change these terms from time to time to comply with regulatory requirements or as our business practices change. Each time you wish to use our website, please review these Terms and Conditions to ensure that you understand the terms in effect at that time. Your use of our website is subject to the most recent version of the Terms and Conditions available on the website. We encourage you to periodically review the Terms and Conditions available on the website to ensure that you are aware of any changes that apply to you.
2. Appliance
These Terms and Conditions apply to all passenger bookings for ferry travel made through this website. In these Terms and Condition: 'You' means the person making the booking; 'Customer' means any of the persons for whom the booking is made, which may (but need not) include you; 'Services' means the services we provide, which include a ferry travel search service, a price comparison service and a booking service. Your use of this website is personal to you only, which means that under no circumstances may you use it for any other business purpose. This means that any use beyond your personal use in your private environment and/or for commercial or business purposes related to you personally and/or other third parties, in particular the commercial resale of tickets, is strictly prohibited.
3. Parties
We do not operate ferries ourselves, as these services are provided by the ferry operators ('Operator(s)'). The contract for booking a ferry journey is concluded exclusively and directly between You and the Operator. On the side of the Operator, the contracts are concluded by us on behalf and for the account of the Operator. We act as a commercial agent for the Operators and are commissioned and authorized by the Operators to conclude transactions between the Operator and You, and for the account of the Operator to collect payments. This means that You enter into a contract with the respective ferry operator, who is responsible for providing the ferry service to You. Any booking you make through our website for ferry services is subject to the following terms and conditions: (I) these booking terms, which set forth the terms and conditions under which we provide our services to you, and (II) the terms and conditions of the ferry service Operators, which set forth the terms and conditions under which the ferry service is provided to you by the Operators. In the event of any conflict or inconsistency between these booking terms and the Operator's terms, the Operator's terms shall prevail. The person making a booking through this website must be authorised to make a booking on behalf of other Customers. When making a booking, You acknowledge that each Customer agrees to be bound by these booking terms. The person making a booking is responsible for their activities on our website and the protection of the personal information they provide, including passwords, names, ID and travel details. The person making the booking must ensure that all the information they provide is complete and accurate.
4. About the ferry services
All prices shown are inclusive prices, i.e. all taxes are already included. Freights are based on vehicle type (if any), number of passengers, route(s), travel dates and times. Your booking require Customers to depart and/or return at specific dates and times. All departure and/or arrival times are estimated by the Operator(s) and are set as local time. We recommend that you check with the Operator(s) for any changes before starting your journey. Schedules may be interrupted and/or crossing times extended or cancelled if weather conditions, tides or other circumstances require. If necessary, alternative ships or departure and/or arrival points on may be used and available facilities/services may be changed/cancelled for various operational, technical or scheduling reasons. We will not be liable for any costs or inconvenience caused by such circumstances. However, we will try our best to inform you via the contact details you provided at the time of booking. The Operators' general terms and conditions apply to the Operators' liability in such circumstances. Vehicle and passenger spaces and onboard accommodations are subject to availability and may not always be available. We have the right to change all displayed fares, including when Operators change their fares (e.g., due to currency fluctuations, oil prices, or changes in law), at any time until a booking is confirmed. Not all Operators have the ability to accept bookings for people with disabilities or reduced mobility. At the time of booking, check on the Operator's website such possibility. The carriage of animals is permitted only if not expressly prohibited in Operator's Terms and Conditions. Any such carriage must comply with the relevant legal provisions and the Operator's requirements. A fee may be charged for the carriage of animals and other conditions may be imposed. You are legally responsible for the animals and fully responsible for obtaining all necessary documents, permits and authorizations. Every Customer is personally responsible for carrying or transporting dangerous or hazardous materials, whether declared or undeclared. If attempting to carry or transport undeclared such materials, no refund will be issued.
5. Payment at Simple Ferry
Simple Ferry is entitled to receive the invoiced amount in the name of and on behalf of the Operator (as a commercial agent). With the successful payment to Simple Ferry, You have fulfilled Your payment obligations toward the Operator with a discharging effect. If the price has to be paid in a currency other than Simple Ferry's local currency and converted to the foreign currency, the exchange rate will be presented at the time of the conclusion of the contract. The total price has to be payed at the time of booking, before a confirmation is issued. Payment can be made by credit card or debit card.When you pay the booking price and have made full payment for all Customers covered by the booking, we will issue a booking confirmation setting out the details of your booking and providing further information based on the information you have provided. The contract between you and the Operator(s) will not be formed until you have received the booking confirmation. We are not obliged to issue a booking confirmation after you have made a booking with us if a problem arises from which we reasonably conclude that we are no longer able to confirm the booking on behalf of the Operator. We will not issue such confirmation if we discover an error in the pricing of the trip or if the trip is no longer available. If for any reason we are unable to accept your booking, we will notify you and will not process your booking further. You agree that the data we store in our information systems constitutes proof of your booking and its details. If you pay by debit or credit card, the amount will be debited from that card at the time of booking. Depending on the type of ticket selected and the number of passengers, a service charge will be added to the ticket price.
6. Cancellation
If the ticket purchased allows for cancellation, the booking may be cancelled and refunded in accordance with these booking conditions and the Operator's conditions. Promotional or special offer tickets may not be refundable and you should check with us at the time of booking to see if there are any additional conditions attached to your ticket that may result in a non- refund. If the Customer does not take the ferry trip for which the booking was made, you will receive a refund only in accordance with the relevant terms and conditions of the Operator.
7. Getting on board
It is at the sole discretion of the Operator whether or not to accept a passenger, his vehicle or baggage on board. Each Customer must be in possession of all necessary travel documents for entry into the countries they intend to visit and for re-entry into the country of departure. You are responsible for ensuring that the name on each Customer's passport matches the name on the ticket, otherwise the customer may not be able to travel and any travel insurance will be invalid. If a Customer changes their name between the date of booking and the date of travel (e.g. after marriage), you must inform us.
7. Getting on board
It is at the sole discretion of the Operator whether or not to accept a passenger, his vehicle or baggage on board. Each Customer must be in possession of all necessary travel documents for entry into the countries they intend to visit and for re-entry into the country of departure. You are responsible for ensuring that the name on each Customer's passport matches the name on the ticket, otherwise the customer may not be able to travel and any travel insurance will be invalid. If a Customer changes their name between the date of booking and the date of travel (e.g. after marriage), you must inform us.
8. Your responsibility
You are responsible to Us and the Operator for fully approving these Booking Terms and any further requirements imposed by the Operator or by law. You are also responsible for providing complete and proper informations about your booking, including the vehicle and Customers. You fully indemnify us for all damages, costs and expenses (including reasonable legal defense costs) incurred by us as a result of: (i) Your culpable misrepresentation, act or omission in connection with Your use of the website, (ii) a culpable failure by you to comply with these Terms of Us (iii) claims by third parties arising out of or in connection with your culpable access to or use of our website not in accordance with these Terms. The foregoing obligations shall only apply if you are responsible for the relevant infringement, i.e. if you have acted intentionally or failed to exercise due care required in the course of trade.
9. Our responsibility
We act as an commercial agent for the Operators and are not responsible for the ferry services they provide. We are responsible for: (I) the provision of the services, (ii) the accuracy of the information we provide. We are not responsible for information not published by us, including information published on the Operators' websites, nor for incorrect information given to us by the Operators. Your contract for the provision of the journey is between you and the Operator. We will not be liable for any loss or damage you incur as a result of the Operator's failure to provide the trip or to do so properly, including if the Operator has become insolvent or otherwise ceased to operate. We are not obligated to provide you with a refund in such circumstances. If an unforeseen event, which is beyond the control of the Operator or Us and therefore could not have been avoided even by our or the Operator's diligence, significantly affects the booked journey, either We or You may cancel the contract. For clarification, an unforeseen event may include war, terrorism, significant risks to human health such as the outbreak of a serious disease at the destination, or natural disasters like hurricanes, earthquakes or bad weather conditions that make safe travel to the contracted destination impossible.
10. Complaints
You must make any complaint about the service promptly and no later than 14 days after completing your booking by contacting Us by mail. If you wish to complain about something that occurred during your journey, please contact the Operator directly to resolve this issue, using the details provided on our website.
11. Final provisions
These booking conditions are subject to the laws of Croatia. You agree that the Croatian courts shall have jurisdiction over any dispute arising out of the interpretation of these Terms. If any provision/part of a provision of these Booking Terms is found by a court or other competent authority to be invalid, illegal or unenforceable, that provision or part shall, to the extent required, be considered not to form part of this agreement with You and the validity and enforceability of the remaining provisions shall not be affected.
